The Nebraska Healthy Families and Workplaces Act, which mandates paid sick leave for employees statewide, was enacted following the passage of Initiative 436 in the November 2024 election. During the 2025 legislative session, state lawmakers amended the Act through LB 415, a bill introduced by Senator Beau Ballard of Lincoln. This legislation incorporated provisions from LB 698, introduced by Senator Paul Strommen of Sidney on behalf of the National Federation of Independent Business (NFIB).
According to the NFIB, "LB 415, as amended, includes LB 698, which was introduced by Senator Paul Strommen (Sidney) on behalf of NFIB. The combined measure amended the Act to provide significant 'clean up' language and add a small business exemption for businesses with 10 or fewer employees. It also eliminated the private cause of action."
Businesses with more than ten employees are now required to comply with new posting requirements issued by the Nebraska Department of Labor. The department has released a model poster that must be displayed in workplaces covered under the Act by September 15, 2025.
